2. GENERAL TERMS OF USE OF THE WEBSITE
2.1. Purpose and scope of the GTU (as defined below)
The sole purpose of the Website is to present premium nursing homes / senior living residences located in Tunisia and intended for international retirees (the “Residences”).
The Website is an informational showcase site exclusively for the user (“You” and “Your”), allowing You to obtain information about the Residences.
Reservations at the Residences must be made strictly in accordance with the procedures set out on the website https://www.silver-resorts.com/ and do not fall within the scope of this Website.
The Residences are made available and managed by third-party entities, for which SILVER RESORTS acts exclusively as an intermediary. You may contact SILVER RESORTS to obtain further information about the Residences and the services offered therein in relation to Your situation or that of Your loved ones.

2.2. Website Content
The Website contains elements protected by intellectual property rights. Each element composing the Website (e.g., images, logos, illustrations, sounds, texts, graphic elements, publications, software, databases, designs and models, and trademarks, etc.) is the exclusive property of SILVER RESORTS or is licensed to it by the holder of the intellectual property rights. (the “Content”)
In light of the foregoing, SILVER RESORTS grants You no right over the Content other than to view it on the Website.
Subject to legal exceptions, it is expressly prohibited to reproduce, download, transmit, represent, or use the Content in any manner or form whatsoever, under penalty of sanctions provided for under both the Intellectual Property Code, notably in respect of copyright infringement (Article L. 331-1 et seq.), trademark rights (Article L. 716-1 et seq.), and the Civil Code in matters of civil liability (Article 1241 et seq.).
In this regard, You are not permitted to:
- Copy, modify, create a derivative work, compile, decompile (except in cases provided for by law), sell, assign, sub-licence, or transfer, in any manner whatsoever, all or part of the Content;

Any hypertext link pointing to the Website must be authorised in advance and in writing by SILVER RESORTS, which reserves the right to request its removal at any time.
2.3. Your liability when using the Website
You are responsible for (i) setting up the IT and communication resources enabling access to the Website, and (ii) having the knowledge required to use the Internet and access the Website.
You bear the connection and equipment costs associated with accessing the Internet and the Website, in accordance with the terms set by your access providers and/or electronic communications operators.
You are aware of the risks of misappropriation and contamination by any viruses circulating on the Internet, or of interruption of Internet communications.
It is noted that (i) gaining or maintaining fraudulent access to a computer system, (ii) disrupting or impairing the operation of such a system, or (iii) fraudulently introducing or modifying data in a computer system constitute offences subject to criminal penalties.
You undertake not to communicate to SILVER RESORTS any information relating to Your own health data or that of Your loved ones, as defined by personal data protection regulations¹. Where necessary, such information will be requested by the managing entities of the Residences.
¹ Data relating to the physical or mental health, past, present, or future, of a natural person (including the provision of healthcare services) that reveals information about the health status of that person. For example, information concerning an illness or certain data from which it is possible to deduce information about a person’s state of health.
2.4. SILVER RESORTS’ liability
SILVER RESORTS endeavours to ensure the accuracy and currency of the information and Content accessible on the Website. However, the Website is provided as is, without any warranty, in particular as regards availability and accuracy, especially with respect to information relating to well-being, medicine, and care that may be accessible on the Website.
SILVER RESORTS accepts liability in the event of a breach of the GTU causing You immediate, direct, certain, and foreseeable harm. However, SILVER RESORTS shall under no circumstances be held liable for, in particular:
- indirect damages of any nature whatsoever;
- damages that may be suffered by Your technical environment, including in particular Your computers, software, network equipment (modems, telephones, etc.) and hardware used to access the Website;
- any decision resulting from Your analysis of information accessible on the Website, whether at the initiative of another user or of SILVER RESORTS, including any information relating to well-being and health.
The Website may contain hypertext links pointing to third-party websites (“Third-Party Sites”). SILVER RESORTS controls neither (i) the content of the Third-Party Sites, nor (ii) the accuracy of the information accessible on the Third-Party Sites. Consequently, SILVER RESORTS shall in no circumstances be liable for damages resulting from Your use of or access to information or content on the Third-Party Sites.
2.5. Amendments to the GTU
SILVER RESORTS reserves the right to modify the Website and the GTU at any time and without notice.
You will be informed of such modifications by any means SILVER RESORTS deems appropriate. We therefore invite You to consult the GTU on a regular basis.
If all or part of the updated GTU is not acceptable to you, you must cease all use of the Website.

2.6. Applicable law and competent courts
The GTU are governed by French law.
For any complaint relating to the use of the Website, please contact SILVER RESORTS at the contact details provided in the header of this document, with a view to reaching an amicable resolution.
Failing that, the complaint shall be referred to the competent court in accordance with applicable law.
